Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Otter Money (the “Service”), operated by Voxcon AI (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Household Accounts

Otter Money is designed for couples to manage finances together through a shared Household. By creating or joining a Household:

• You acknowledge that your partner will have full visibility into all financial data within the Household, including linked accounts, transactions, budgets, and goals.
• You are responsible for ensuring that you have proper authorization to link any financial accounts to the Household.
• The Household organizer can manage membership, including removing partners from the Household.

4. Financial Data and Third-Party Services

• The Service integrates with third-party financial data providers, including Plaid and SimpleFin, to access your financial account information.
• By connecting your financial accounts, you authorize these providers to access your account data on your behalf in accordance with their respective terms and privacy policies.
• We do not store your bank login credentials. All authentication with financial institutions is handled by our third-party data providers.
• Financial data displayed in the Service is provided for informational purposes only and may not reflect real-time balances or transactions.

5. AI-Powered Features

The Service includes Wally, an AI-powered financial assistant. By using Wally:

• You acknowledge that Wally’s responses are generated by artificial intelligence and are for informational purposes only.
• Wally does not provide financial advice, investment recommendations, or tax guidance. Always consult a qualified financial professional for such matters.
• Your household financial data may be processed by third-party AI services (Anthropic) to generate responses. See our Privacy Policy for details.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service, other user accounts, or connected systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means (bots, scrapers, etc.) to access the Service without our written consent
• Upload or transmit malicious code, viruses, or harmful data
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Use the Service to harass, abuse, or harm another person

7. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Voxcon AI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Financial data displayed will be accurate, complete, or current at all times
• The Service will meet your specific requirements or expectations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXCON AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

We are not responsible for any financial decisions you make based on information displayed in the Service or provided by the Wally AI assistant.

10. Indemnification

You agree to indemnify, defend, and hold harmless Voxcon AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

11. Termination

• You may terminate your account at any time by contacting us or using the account deletion feature in the app.
• We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
• Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

12. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
